|1. As a service to our customers, Nick’s Furniture will process all written factory warranties. THERE ARE NO OTHER WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, AND ALL WARRANTIES, GUARANTEES OR REPRESENTATIONS OF MERCHANTABILITY, VALUE, AND QUALITY. WORKMANSHIP AND FITNESS FOR AN INTENDED USE OR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. Nick’s Furniture does not provide warranties for any furniture. All merchandise sold off the floor is sold “AS IS” and carries no warranties or guarantees whatsoever from the manufacturer or Nick’s Furniture and will not be serviced by Nick’s Furniture.
2. All changes to any order/invoice, if approved by Nick’s Furniture, must be signed and approved by the customer.
3. There are no cancellations or returns to any orders unless approved by Nick’s Furniture. If a return is approved at the sole discretion of Nick’s Furniture, the customer is subject to a 25% re-stocking fee.
4. Any customer paying by credit card authorizes that the deposit is charged immediately at the time of purchase or order, and the balance shall be paid before the merchandise is released. All credit card purchases must be made in person, authorized by the customer’s signature, and made at the location of purchase.
5. All merchandise and/or delivery dates are estimates only. Nick’s Furniture does not manufacture the merchandise and shall not be liable for any delays in delivery of any merchandise. Any claims for damage to merchandise must be noted at the time of delivery. Thereafter, customer agrees that it shall be presumed that any damage to merchandise occurred after delivery and customer will be responsible for any repairs to said merchandise.
6. Merchandise must be paid in full and delivery accepted by the customer within 14 days of arrival of the merchandise at Nick’s Furniture. Thereafter, a storage charge of 10% of the purchase price will be added to the invoice and the customer’s balance each month. In the event any merchandise is not picked, or delivery is not accepted by the customer within 120 days after arrival at Nick’s Furniture, such order may be cancelled and any deposit forfeited at the option of Nick’s Furniture. Nick’s Furniture may thereafter re-sell such merchandise.
7. Nick’s Furniture assumes no responsibility for damage incurred to customer’s personal property during delivery. Customer agrees to pursue any such claims with the delivery company directly.
8. When picking up merchandise from Nick’s Furniture, the customer assumes full responsibility for loading and transportation, and Nick’s Furniture is not responsible for any damage to the merchandise, vehicle, or personal property of the customer.
9. Nick’s Furniture assumes no responsibility for the customer negligence in ordering of merchandise, including but not limited to, inability of merchandise to fit into a room area, or incorrect measurements of doors, window, hallways, stairwells, or other areas where the furniture is to be placed.
10. ALL SALES ARE FINAL. NO RETURNS, REFUNDS, EXCHANGES, OR CANCELLATIONS. ALL DEPOSITS ARE NON-REFUNDABLE. ANY LIABILITY OF NICK’S FURNITURE SHALL BE LIMITED TO THE PRICE OF THE MERCHANDISE. NICK’S FURNITURE SHALL IN NO EVENT BE LIABLE FOR SPECIAL OR CONSEQUENTIAL DAMAGES.
